Declaratory Judgment

Another common cause of action under Texas law in commercial litigation is declaratory judgment.  A declaratory judgment is where one party is asking the court to determine the rights of the parties under the agreements that they had or under the arrangements that they had.  A court will come in and will declare the rights and the duties of all parties.  One of the advantages of a declaratory judgment action is that the party who wins gets their attorney fees, one of the disadvantages of a declaratory judgment action in Texas is that the party that loses must pay the other sides attorney fees.
