Under Texas law it's not illegal to have someone over the age of 18 in the bed of the pickup truck that’s being driven. However, if that pickup truck is involved in accident or that person falls out of the truck, then the driver may be negligent for any injuries as a result. Just because it’s not illegal for criminal purposes doesn't mean that you are not negligent.
